Employment Terms – LAW CLERK – MATERNITY LEAVE POSITION


Terms:                       

Full time hours commencing: Monday June 17, 2024 to Friday June 20, 2025


Hours of Work:         

8:30 a.m. to 5:00 p.m., ½ hr. for lunch. Depending on the work load, you may be expected to work beyond 5:00 p.m. in order to complete required tasks.


Depending on your level of experience, in-office training at part-time hours to start in April or May 2024

 A competitive hourly wage based on your experience level shall be offered based on a 40 hour work week.

There are no health care, dental or pension benefits offered with this position.

Depending on your past experience level with Worker’s Compensation matters, I would also expect you to take home materials and read up on Workplace Safety and Insurance Board practices and procedures on your own time in preparation for the position. 

Requirements of the Position:

Minimum 3 - 5 years experience working as a Law Clerk in a personal injury law practice, preferably a practice involving ongoing claims for Worker’s Compensation benefits on behalf of injured workers including appeals before the Workplace Safety and Insurance Board (“WSIB”) and the Workplace Safety and Insurance Tribunal (“WSIAT”).  Experience in requesting, reviewing and summarizing medical notes and records.  Familiarity with the following software: Word, Adobe Acrobat, PC LawJr., Microsoft Outlook, Microsoft Explorer

Probationary Period:     

Your employment will be subject to a three-month probationary period.  Your employment may be summarily terminated at any time during this three-month period without advance written notice or severance. 


Holidays:                        

4% of salary will be paid as vacation pay and added to each pay cheque in lieu of taking scheduled vacation days. A minimum of 8 days unpaid leave will be permitted and scheduled at the sole determination of the McGill Law Firm.


All usual statutory holidays will be paid.


Confidential Information:

You acknowledge that as my law clerk you will acquire information about certain matters and my clients’ personal affairs which are confidential to my clients and is the exclusive property of my clients. You understand and acknowledge that as a solicitor I must respect the confidentiality of information provided by clients and am duty bound to protect such confidential information and not disclose same except when required to perform my duties. You understand and acknowledge that, by extension, as my employee you are also duty bound by this duty of confidentiality and you agree not to breach this duty. You further understand, acknowledge and agree that any breach of a client’s right to confidentiality may be grounds for the summary termination of your employment.

Regular Duties:            

Your duties will include litigation support in this single lawyer practice which is comprised primarily of Administrative Law proceedings including appeals pursuant to the Workplace Safety & Insurance Act and Canada Pension Plan Act Disability Pension appeals.


Duties and responsibilities will include general office duties such as filing, word processing and dealing with the incoming and outgoing flow of correspondence.  As well, you will assist in preparation of cases for W.S. & I.B. Appeals as follows: review and summarizing of WSIB Claims Access files in accordance with office procedure, preparation of medical briefs, summarizing medical reports including doctor’s handwritten clinical notes and record, etc.  Review and organization of files including: conducting initial client phone intake interviews, file opening/activation procedures, file organization, attending to outgoing correspondence, gathering of relevant medical documentation, summarizing of medical evidence, preparation of treatment chronologies, requesting Expert Medical reports, preparation of written submissions to the W.S.I.B., diarizing and following up for rulings from WSIB claims adjudicators, attendance to Pre-hearing preparation check lists and such other duties as may be assigned from time to time.
